INTRANET POLICY
Definitions
"LaTourDallas.com" is an interactive intranet service operated by La Tour
Condominiums consisting of information services and content provided by
Intercity Management Inc., the La Tour Board, the La Tour residents and other
third parties. "Member" means each person who establishes or accesses a
connection ("Account") for access to and use of the site "LaTourDallas.com." The
site "LaTourDallas.com" will hereinafter be referred to as the "Site."
"Account"
means access to or connection to the Site with a username and password
authorized by La Tour Condominiums.
General
The Site is intended to provide information and resources for those interested
in learning about La Tour Condominiums and its surrounding community. By
using/accessing the Site, you indicate your agreement to every term of this Site
set forth below. If you do not agree to the terms of this Site, please do not
access LaTourDallas.com. All information and communications transmitted by,
received from, or stored in the Site are property of La Tour Condominiums.
La Tour Condominiums does not warrant or guarantee the accuracy, adequacy,
quality, currentness, validity, completeness, or suitability of any information
for any purpose. Without notice, La Tour Condominiums shall have the right at
any time to change, correct, update or discontinue any aspect or feature of the
Site, including, but not limited to, content, access, hours of availability,
interactivity, and equipment needed for access or use.
Links to other websites have been provided in the hope that they will be helpful
in the search for information. Please understand that La Tour Condominiums is
not associated with these websites and their inclusion within this Site does
not, either expressly or impliedly, constitute an endorsement of the sites by La
Tour Condominiums.
Changed Terms
La Tour Condominiums shall have the right at any time to change or modify the
terms and conditions applicable to Member's use of the Site, or any part
thereof, or to impose new conditions. Such changes, modifications, additions or
deletions shall be effective immediately upon notice thereof, which may be given
by means including, but not limited to, posting on the Site, or by electronic or
conventional mail, or by any other means by which Members obtain notice thereof.
Any use of the Site by a Member after such notice shall be deemed to constitute
acceptance by Member of such changes, modifications or additions.
Equipment
Member shall be responsible for obtaining and maintaining all telephone,
computer hardware and other equipment needed for access to and use of La Tour
Condominiums' connections to airBand and all charges related thereto.
Member Conduct
Member shall use the Site for lawful purposes only. Member shall not post or
transmit through the Site any material which violates or infringes in any way
upon the rights of others, which is unlawful, threatening, abusive, defamatory,
invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise
objectionable, which encourages conduct that would constitute a criminal
offense, give rise to civil liability or otherwise violate any law, or which, is
without La Tour Condominiums' express prior approval. Any conduct by a Member
that in La Tour Condominiums' discretion restricts or inhibits any other Member
from using or enjoying the Site will not be permitted.
Member shall not upload, post or otherwise make available on the Site any
material protected by copyright, trademark or other proprietary right without
the express permission of the owner of the copyright, trademark or other
proprietary right and the burden of determining that any material is not
protected by copyright rests with Member. Member shall be solely liable for any
damage resulting from any infringement of copyrights, proprietary rights, or any
other harm resulting from such a submission. By submitting material to any
public area of the Site, Member hereby grants La Tour Condominiums the right to
edit, copy, publish and distribute any material submitted to the Site by Member.
Monitoring
La Tour Condominiums shall have the right, but not the obligation, to monitor
the content of the Site to determine compliance with this Agreement and any
operating rules established by La Tour Condominiums and to satisfy any law,
regulation or authorized government request. La Tour Condominiums shall have the
right in its sole discretion to edit, refuse to post or remove any material
submitted to or posted on the Site. Without limiting the foregoing, La Tour
Condominiums shall have the right to remove any material that La Tour
Condominiums, in its sole discretion, finds to be in violation of the provisions
hereof or otherwise objectionable.
Termination
Without limiting the foregoing, La Tour Condominiums shall have the right to
immediately terminate a Member's account in the event of any conduct by Member
which La Tour Condominiums, in its sole discretion, considers to be
unacceptable, or in the event of any breach by Member of this Agreement.
Miscellaneous
This Agreement constitutes the entire agreement between Members and La Tour
Condominiums with respect to the subject matter hereof, and supersedes all
previous written or oral agreements between the parties with respect to such
subject matter. This Agreement shall be construed in accordance with the laws of
the State of Texas, without regard to its conflict of laws rules. No waiver by
either party of any breach or default hereunder shall be deemed to be a waiver
of any preceding or subsequent breach or default. The section headings used
herein are for convenience only and shall not be given any legal import.
Privacy Policy
We have put in place appropriate physical, electronic, and managerial procedures
to safeguard and help prevent unauthorized access, maintain data security, and
correctly use the information we collect through the Site. To protect your
privacy and security, we will take reasonable steps to help verify your identity
before granting access to the Site.
The Site contains links to other sites whose information practices may be
different than ours. Members should consult the other sites' privacy notices as
we have no control over information that is submitted to, or collected by, these
third parties.
La Tour Condominiums may disclose personally identifiable information in
response to legal process, for example, in response to a court order or a
subpoena. La Tour Condominiums also may disclose such information in response to
a law enforcement agency's request.
Members are responsible for all use of the Member's account (under any screen
name or password) and for ensuring that all use of the Member's account complies
fully with the provisions of this Agreement. Member shall be responsible for
protecting the confidentiality of Member's password(s), if any.
Disclaimer of Warranty; Limitation of Liability
(A) Member expressly agrees that the use of this Site is at Member's sole risk.
La Tour Condominiums does not warrant that the Site will be uninterrupted or
error free; nor does it make any warranty as to the results that may be obtained
from use of the Site, or as to the accuracy, reliability or content of any
information, service, or merchandise provided through the Site.
(B) The Site is provided on an "AS IS" basis without warranties of any kind,
either express or implied.
(C) This Disclaimer of Liability applies to any damages or injury caused by
failure of performance, error, omission, interruption, deletion, defect, delay
in operation or transmission, computer virus, communication line failure, theft
or destruction or unauthorized access to, or alteration of the Site. The risk of
injury from the foregoing rests entirely with Member.
